Terms of Service
These Terms, the Acceptable Use Policy and the Privacy Policy together govern your use of RunMac.
1. Agreement
These Terms form a binding agreement between you ("Customer", "you") and RooNow for your use of the RunMac service. By creating an account, placing an order, or using a Mac, you accept these Terms, the Acceptable Use Policy and the Privacy Policy. If you are agreeing on behalf of a business, you confirm you are authorised to bind it.
2. What the service is
- RunMac rents you a dedicated Apple Mac mini ("the Mac"): bare metal, for your exclusive use for the duration of your lease. We do not time-share a Mac between customers or sell virtual slices of one Mac to different customers.
- The Mac is hosted in Sydney, Australia, and you may access and use it from anywhere you are lawfully able to. You access it remotely (for example SSH and Screen Sharing) using credentials we provide.
- The minimum lease is 24 consecutive hours. Leases are sold for the terms shown at checkout (24 hours, one week, one month, three months, six months or twelve months).
3. Permitted use (developer services only)
You may use the Mac only for software development services: building, testing, continuous integration (CI) and development, consistent with Apple's macOS Software Licence Agreement, section 3 ("Leasing for Permitted Developer Services"). You must:
- use the Mac exclusively for your own development work for the lease term;
- accept Apple's macOS Software Licence Agreement, which governs your use of macOS on the Mac;
- comply with the Acceptable Use Policy.
Use outside permitted developer services, including running the Mac as a general consumer device, a public production server, or for the activities listed in the Acceptable Use Policy, is a breach of these Terms and of Apple's licence.
4. Your Apple Account and software
- You install Xcode and other developer tools using your own Apple Account. We do not provide an Apple Account, and unless we tell you otherwise in writing we do not pre-install Xcode.
- You are responsible for complying with the licence terms of any software you install, and for any Apple Account you sign into on the Mac. Do not use the Mac to create or farm Apple Accounts, or to abuse Apple services.
5. Eligibility, verification and sanctions
- You must be at least 18 and able to form a binding contract.
- We may carry out identity or business verification and a payment-method check at signup, and may decline or suspend service if verification fails or we reasonably suspect fraud or misuse. See the Privacy Policy for what we collect.
- RunMac serves customers worldwide. By using the service you confirm that you are not located in, ordinarily resident in, or ordering on behalf of anyone in a country or region subject to comprehensive trade sanctions (for example as administered by the UN, Australia (DFAT), the United States (OFAC) or the EU), and that you are not a person or entity on an applicable sanctions or denied-parties list. You will not use the Mac in breach of applicable export-control or sanctions laws. We may refuse, suspend or terminate service to comply with these laws.
6. Fees, billing and taxes
- Fees are shown at checkout in US dollars, per Mac model and lease term.
- Payment and invoicing are handled by Stripe. We do not store your full card number.
- Taxes: prices exclude tax. Any applicable tax (such as Australian GST, or overseas VAT or sales tax) is calculated and added at checkout based on your billing country, shown before you pay, and itemised on your invoice.
- Merchant of record: for customers in the United Kingdom, the European Union, Canada and certain other countries, the sale is made through Link, LLC (a Stripe company) as merchant of record. Link issues the receipt, collects and remits local tax, and handles refunds and disputes under its own terms; the service itself is provided by RooNow under these Terms. Everywhere else RooNow is the seller.
- Leases are prepaid for a fixed term and do not renew automatically. You can renew from your dashboard at any time before the term ends; an unrenewed Mac is erased and released when the paid period ends. The 24-hour minimum applies to every term.
- Refunds: fees are non-refundable, including for unused time on a prepaid term, except where the Australian Consumer Law or a mandatory consumer-protection law of your country requires otherwise.
7. Term, suspension and termination
- Your lease runs for the term you pay for and renews under section 6.
- We may suspend or terminate your access, end a lease, or wipe the Mac immediately if you breach these Terms or the Acceptable Use Policy, if your payment fails, if verification fails, or if your use threatens the security, integrity or lawful operation of the fleet or another person. Where practical and safe we will give notice; for serious or abusive breaches we may act first and notify after.
- On termination or at the end of a lease, your access ends and the Mac is erased (section 8). You remain responsible for fees accrued up to termination.
8. Your data on the Mac
- You are responsible for your own backups. Keep your code and data in your own version control or storage off the Mac.
- Between customers, and at the end of your lease, we run Apple's "Erase All Content and Settings" and re-provision the Mac. After that, data from your lease is not recoverable.
- We do not provide shared storage, and we do not access, copy or back up the contents of your Mac for you.
9. Monitoring
We run a lightweight agent on each Mac that reports aggregate resource metrics only: CPU %, memory %, free disk, network throughput totals, and a count of open sessions, for capacity planning and abuse prevention. It never reads your files, file names, the names of programs you run, or your commands. Full detail is in the Privacy Policy.
10. Availability and maintenance
- We aim for high availability but provide the service "as is" and "as available" with no uptime guarantee. Outages can occur from power, network, hardware or Apple-side issues.
- We may perform maintenance, apply security updates, or move hardware, and will try to minimise disruption.
11. Security and isolation
- Each Mac runs the macOS firewall in stealth mode and is network-isolated from other customers' Macs and from our own network.
- You are responsible for securing what you run on the Mac, for your own credentials, and for not weakening the Mac's security or isolation.
12. Australian Consumer Law and your local rights
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (ACL), or under any mandatory consumer-protection law of your own country, that cannot lawfully be excluded. Where our liability for failing to comply with a consumer guarantee can be limited, it is limited (at our option) to re-supplying the service or paying the cost of re-supply.
13. Liability
Subject to section 12, and to the maximum extent permitted by law:
- we are not liable for indirect or consequential loss, loss of profits, loss of data, or loss arising from your failure to keep backups; and
- our total liability arising out of or in connection with the service is limited to the fees you paid in the 3 months before the event giving rise to the claim.
14. Your indemnity
To the extent permitted by law, you indemnify us against claims, losses and costs arising from your breach of these Terms or the Acceptable Use Policy, your use of the Mac, or content or software you place or run on it.
15. Intellectual property
You keep all rights in your own code and data. We keep all rights in the RunMac platform, software and brand. "Apple", "Mac", "Mac mini" and "macOS" are trademarks of Apple Inc.; RunMac is an independent service and is not endorsed by or affiliated with Apple.
16. Changes
We may update these Terms, the Acceptable Use Policy or the Privacy Policy. We will post the new version at runmac.dev and, for material changes, give reasonable notice. Continued use after the effective date means you accept the change.
17. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts. If you are a consumer resident elsewhere, mandatory consumer-protection laws of your country of residence may still give you rights this clause does not override.
